Burn Permits
Burning Regulations

Burn permits are availble for free at the fire station.

Burn permits are good for the current calendar year and a new one must be obtained each year.

Brush and Open Burning
  • Open burning within the town of Windham, requires a permit.
  • Permits may be obtained at the Windham Fire Department.
  • A permit for the purpose of burning brush shall only be issued during a day of rain or when the ground has total snow cover. The permit for brush shall be issued and in force only during daylight hours (9 am to sunset). At the end of the timeframe allotted, the fire shall be completely extinguished. The diameter of brush, slash, limbs etc. shall never exceed five (5) inches in diameter.
  • At no time shall any fire be left unattended.
  • It shall be the responsibility of all applicants to take every precaution not to burn any material within fifty (50) feet of any structure.
  • Brush piles shall be no larger than five (5) feet in diameter and five (5) feet in height.
  • Applicants shall not burn or cause to be burned any material near or under trees, dead vegetation, phone lines or power lines.
  • Persons applying for a burning permit must own the property where the fire is located. Persons renting or leasing property must produce a written consent from the property owner to the fire department before a permit will be issued.
  • At no time shall any person or persons burn any material such as tires, waste, painted, stained or pressure treated lumbers, asphalt shingles, metals, plastics or any other material which may be deemed toxic or a pollutant which may be harmful to the environment or public.
  • If the fire department receives any public complaint that a fire is creating a nuisance the permit shall be revoked and the fire must be extinguished. The burying of any fire shall not be deemed to be extinguished.
  • No permits will be issued to any youth under the age of eighteen (18) years old without the written approval and consent of a parent or guardian. A phone number where the parent or guardian can be reach for verification must also be provided.
  • Smoke generated from any fire shall never impede or obstruct traffic. The travel distance of hot ash shall never cause a threat of any kind.
  • The burning of leaves shall be prohibited.
  • All permits for any type of open burning shall be suspended during any state ban, which encompasses by territory the town of Windham, NH.


Cooking and Campfires

Permit shall be issued per event. Permit shall be issued during daylight or evening hours. A proper method for control and extinguishment shall be provided. These fires shall also follow the guidelines and requirements listed above, with the exception of those listed here in. (This is not a seasonal permit.)

Grass Fire Permits

These permits shall only be issued when, in the opinion of the Chief of the Windham Fire Department and State Forest Ranger, all possible means to control and extinguish such fires are in place. These permits shall only be issued with said prior approvals and on a case-by-case basis.

Commerical Brush and Debris Permits

These permits shall be issued per event and are subject to inspection prior to firing. Commercial applicants are subject to all the criteria listed above in the section of brush and open burning. At no time shall any commercial entity burn or cause to be burned any other material than clean wood and wood scraps as listed above. Commercial applicants may not burn at anytime any other materials including cardboard and paper products. Commercial entities shall not be allowed to apply for incinerator or debris permits. These items should be removed offsite. They will not be permitted to be burned.
